UpBonsai is a brand of Gerlach LLC. For this website, Gerlach LLC is the business responsible for personal information described here. You can reach us at contact@upbonsai.com.

Information you give us

If you use the contact form or the email field in the footer, your browser opens an email to contact@upbonsai.com. We do not store that form on our servers. We receive your name, email address, topic, and message only if you send the email.

You might also email us directly, or share details on a call after we reply. We use that information to respond, to decide whether we should work together, to prepare a proposal, and to keep a record of the conversation.

Please do not send passwords, government ID numbers, payment card numbers, or health information through the website form.

Information collected when you browse

If you use the Light or Dark control, we store that choice in a cookie named upbonsai-theme and in local storage under the same name, so the site can open in the mode you picked. Details are on our cookie policy.

Our hosting provider may keep technical logs of requests to the site, such as IP address, browser type, the page requested, and the time of the request. Those logs are used to operate, secure, and troubleshoot the site.

We do not run advertising or analytics tools on this website, and we do not build a marketing profile of visitors.

How we use information

We use personal information to:

• Reply to inquiries and schedule conversations
• Reply to you and prepare a scope for the work
• Remember your light or dark mode choice
• Keep the site available and secure, and diagnose problems
• Meet legal obligations and respond to lawful requests

How we share information

We do not sell personal information. We do not share it for cross-context behavioral advertising.

We share information with service providers who host the site or handle email, and only so they can provide that service. We may share information if the law requires it, or to protect the rights, safety, and security of UpBonsai, our clients, or others.

If Gerlach LLC is involved in a merger, acquisition, or similar business transfer, contact records may transfer with the business. The recipient would still be bound to handle them in line with this policy.

How long we keep it

Inquiry emails are kept long enough to reply, to follow up, and to keep a record of what was discussed. If we do not work together, we keep the thread only as long as we need it for those purposes, then delete it or remove identifying details.

If we do work together, records related to the engagement are kept for the life of that work and for as long as we need them for accounting, tax, and legal obligations. The theme preference stays in your browser until it expires or you clear it. Hosting logs follow our provider’s ordinary retention for security logs.

Security

We use reasonable administrative and technical measures to protect information we hold, including access limited to people who need it to respond to you. No method of email or internet transmission is completely secure, and we cannot guarantee absolute security.

Your choices and rights

You can ask us what inquiry information we have about you, ask us to correct it, or ask us to delete it. Email contact@upbonsai.com with the subject “Privacy request.” We may need to confirm that the request comes from you.

Depending on where you live, including California and other U.S. states with consumer privacy laws, you may have the right to know, access, correct, or delete personal information, to opt out of sale or sharing, and to appeal a denial. We do not sell or share personal information as those laws define those terms. We will not discriminate against you for making a request. We will respond within the time your local law requires.

You can control the theme cookie from your browser, as described in the cookie policy. Because the contact form uses your email application, you can also choose not to send the draft.

Children

The site is meant for businesses and the people who operate them. We do not knowingly collect personal information from children under 13. If you believe a child has sent us personal information, email contact@upbonsai.com and we will delete it.

International visitors

We operate from the United States. If you contact us from another country, your information will be processed in the United States, where privacy laws may differ from those where you live.

Client software

Software we deliver to a client may collect information about that client’s users. That collection is described in the client’s own notices and in the agreement for the engagement, not in this policy.

Changes

If we change this policy, we will update the date at the top of the page. The new policy applies to information we collect after that date.
